1. Introduction

Welcome to CheckIn Health ("we", "our", "us"). These Terms and Conditions ("Terms") govern your use of our website checkin.health and all related services, including health testing, blood analysis, report generation, and home sample collection (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Definitions

  • "User" or "You" refers to any individual who accesses or uses our Services.
  • "Platform" refers to the CheckIn Health website, mobile application, and any associated services.
  • "Test" refers to any blood test, health screening, or biomarker analysis offered through our Platform.
  • "Report" refers to the health score report and analysis generated from your test results.

3. Eligibility

To use our Services, you must be at least 18 years of age and capable of entering into a legally binding agreement under the Indian Contract Act, 1872. If you are under 18, you may only use our Services with the consent and supervision of a parent or legal guardian.

4. Services Offered

CheckIn Health provides:

  • Comprehensive blood testing and biomarker analysis across 7 live health systems.
  • Home sample collection by trained phlebotomists at your preferred location.
  • Personalised health scores and reports based on your biomarker results.
  • Health insights and recommendations generated from your test data.

Important: Our Services are intended for informational and preventive wellness purposes only. They do not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical decisions.

5. User Account and Registration

  • You must provide accurate, complete, and current information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorised use of your account at hello@checkin.health.

6. Payments and Pricing

  • All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
  • Payment must be completed at the time of booking through our accepted payment methods (UPI, credit/debit cards, net banking, or other supported gateways).
  • We reserve the right to modify pricing at any time. Price changes will not affect orders that have already been confirmed.
  • For subscription or annual plans, charges are billed as per the selected billing cycle. You will be notified before any renewal.

7. Booking and Scheduling

  • Upon successful payment, you may schedule a home sample collection at your preferred date, time, and location (subject to availability in your service area).
  • You must ensure you are available at the scheduled time and location for sample collection.
  • If you need to reschedule, please do so at least 12 hours before the scheduled collection time.
  • We reserve the right to reschedule or cancel a collection due to unforeseen circumstances. In such cases, you will be notified promptly and offered an alternative slot or a full refund.

9. Health Data and Reports

  • Test reports are typically made available within 24–72 hours after sample collection, depending on the tests ordered.
  • Health scores and insights are generated using our proprietary algorithms and are based on established biomarker reference ranges.
  • Reports are for your personal use and should not be considered a substitute for professional medical advice.
  • We take reasonable measures to ensure accuracy but do not guarantee that results are free from errors. Laboratory testing inherently has limitations.

10. Privacy and Data Protection

We are committed to protecting your personal and health data in accordance with the Digital Personal Data Protection Act, 2023 (DPDPA) and applicable Indian laws. Key points:

  • Your health data is stored securely and is accessible only to you and authorised personnel.
  • We do not sell, rent, or share your personal health data with third parties without your explicit consent, except as required by law.
  • You may request access to, correction of, or deletion of your personal data by contacting us.
  • We use encryption and industry-standard security measures to protect your data during storage and transmission.

11. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, software, health scoring algorithms, and reports, is the property of CheckIn Health and is protected under the Copyright Act, 1957 and other applicable intellectual property laws of India. You may not reproduce, distribute, or create derivative works without our prior written consent.

12. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of these Terms.
  • Provide false or misleading personal or health information.
  • Attempt to gain unauthorised access to our systems, servers, or databases.
  • Use automated tools (bots, scrapers) to access or collect data from the Platform.
  • Resell, redistribute, or commercially exploit our Services or reports without authorisation.

13. Limitation of Liability

To the maximum extent permitted by applicable law, CheckIn Health shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
  • Any health decisions made based on our reports or recommendations. Our Services do not replace professional medical advice.
  • Delays or failures in service due to circumstances beyond our reasonable control (force majeure events).
  • Any inaccuracies in test results caused by factors beyond our control, including pre-analytical variables.

Our total liability for any claim shall not exceed the amount paid by you for the specific Service giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless CheckIn Health, its directors, employees, partners, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your breach of these Terms or misuse of our Services.

15. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of our Services after any modifications constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.

17. Grievance Redressal

In accordance with the Information Technology Act, 2000 and rules made thereunder, the Grievance Officer for the purpose of these Terms is:
